Paid Leave for Employees in Malaysia's Legislation

At some point, nearly everyone will need to take time away from work to deal with a serious personal or family illness, or to care for a new child.


Paid annual leave for employees:
Less than two years of service:8 days
Two or more but less than five years of service:12 days
Over five years of service:16 days

*Minimum paid annual leave to be provided for employees
Paid sick leave per calendar year:
Less than two years of service:14 days
Two or more but less than five years of service:18 days
Over five years of service:22 days
Where hospitalisation is necessary:up to 60 days (inclusive of the paid sick leave entitlement stated above)
*Minimum paid sick leave to be provided for employees

Payment for overtime work:
Normal working days:one-and-a-half times the hourly rate of pay
Rest days:two times the hourly rate of pay
Public holidays:three times the hourly rate of pay

Right of Pregnant Women at Work

Most women can keep working throughout their pregnancy and some even choose to work until a day or two before the birth. But for every woman it's important to make sure you plan ahead, inform the relevant people, and ensure that you're working in a safe environment.

Accept help
If you tell a friend at work about the pregnancy early on you also have a confidant – and someone who can keep an eye out for you. Many women experience morning sickness and your colleague can simply make sure you are OK. As you get further along in your pregnancy, coworkers may offer to help more and more – say yes and consider yourself lucky to be working in a supportive working environment.

Eat well and often
You'll need to increase your energy requirements, as well as nutrients such as iron, folate, iodine, zinc and vitamin C. Natasha Murray, an accredited practising dietician and spokesperson for Dieticians Association of Australia (DAA) says that a pregnancy multi-vitamin is sufficient for most women. She stresses that eating regularly is pivotal. "You might need to schedule in lunch breaks, as well as morning and afternoon tea. I'd recommend taking your own lunch and snacks to work, so that if you're having a hungry day you've got nutritious food close at hand."

Relax and minimise stress
Pregnancy can be an emotional rollercoaster and some women find it challenging to maintain equilibrium. Try to eliminate stress, but if you can't get away from it then manage it through deep breathing exercises, yoga, meditation – or simply by going for a walk. Cottle reminds expectant mums to "recognise that growing a new human puts a lot of strain on your body and emotions. Don't expect too much of yourself. If you have sick leave and you need a day off because you're feeling unwell or overly stressed – take it."

Minimum Conditions of Employment
The Employment Act, 1955 is the main legislation on labour matters in Malaysia.

Paid maternity leave : 60 days
Normal work hours : Not exceeding eight hours in one day or 48 hours in one week
Paid holiday : At least 11 gazetted public holidays 
(inclusive of five compulsory public holidays; National Day, Birthday of the Yang Dipertuan Agong, Birthday of Ruler/Federal Territory Day, Labour day and Malaysia Day) in one calendar year and on any day declared as a public holiday under section 8 of the Holiday Act 1951

Advantage and Disadvantage of Recruitment Agency


Recruitment Agencies – you can love them or hate them, however just like any relationship, it’s about knowing how to manage the relationship effectively. Remember, it’s not just what’s in it for you, but also what’s in it for them!
There are advantages and disadvantages to using Recruitment Agencies, and many of you may have experiences you’d like to share too on how to use (and not use) Recruitment Agencies.

Advantages

Specialist Recruitment Agencies in your field will recognise and understand your expertise
They can give you objective feedback on your Application and how to promote yourself
They will also have a good knowledge of the market place
They may have excellent contacts in organisations that could be of interest to you
They save you the time of searching for job opportunities.

Disadvantages (sadly all of these points below have been experienced by some of our clients)
Recruitment Agencies may be sympathetic about your situation, however do not have the time to invest in helping you with your issues
You may not always know who the client is until the last minute, which restricts your ability to fully research the company and interviewers
They decide which candidates are put forward for jobs – you may miss out or not know if the brief has changed
If you are looking for a Career Change, they may not listen to you and keep wanting to put you forward for roles similar to what you have done in the past
Can be quite impersonal and not keep in touch
May amend your CV and make mistakes.

Tips
Remember that Recruitment Agencies are not paid by you, they are paid by their client, the employer, so may have a different agenda to you
Don’t register with too many Recruitment Agencies – be selective. Choose those that either specialise in your Role or the Industry you are interested in
Ensure all communication with them is professional and build good rapport with the Recruitment Consultant
Always check that the Recruitment Agency is a member of the Recruitment and Employment Confederation (REC), the only professional body dedicated to representing the whole of the recruitment industry.
